Spanish Court Asks For Preliminary Ruling On Whether Google Must Delete Personal Material On Request

Spain’s highest court has requested a preliminary ruling from the European Court of Justice on the matter of the “right to be forgotten.” Specifically, it has asked the ECJ whether Google must delete material from the net if individuals ask it to do so, even if they had previously given consent to publication of the material and even if it did not create the content originally. The Spanish court is also asking the ECJ whether requesters must direct their requests to Google headquarters in California, or whether they may ask Google Spain to delete the material.
