Fox News Reporter Defends Her Right To Protect Sources in Holmes Case Before New York’s Highest Court

The New York State Court of Appeals will hear arguments from Fox News reporter Jana Winter that James Holmes’ defense team should not be able to subpoena her to give testimony in his case. Ms. Winter reported that Mr. Holmes had sent a notebook to his psychiatrist shortly before he allegedly opened fire at an Aurora, Colorado, movie theater in July of 2012. Twelve persons died and fifty were injured that night.

Ms. Winter has lost at the New York trial and appellate court levels, those courts ruling that the issue is one for the Colorado courts to decide, and that Colorado’s shield law, not New York’s shield law, is applicable.
